In 2011 Will You Be Facing an IRS Tax Lien or an Early Refund?

By J. Stefan

The year 2010 has been tough for many Americans because of the loss of so many jobs, the economy doing a double dip at times, and even some folks were faced with foreclosure. All these things have made the year rough and now it is tax time. What are you expecting this time will you be facing an IRS tax lien or an early refund? Many people who had good jobs and earned a lot of money in the first part of the year 2010 lost it all about the middle of the year when they lost their jobs. This tragedy could cause many tax payers to owe the IRS taxes but without the means to pay. This is not unexpected for tax payers this year because of the rough year we have all suffered through in 2010.

When you owe unpaid back taxes and are not able to make payments, you may find that the tax agent may put a tax lien on some of your property. The most important thing to remember is to file your taxes on time and try to file them as accurately as possible. This will help keep your penalties down to a minimum. It is wise to hire a lawyer who can help you negotiate with the government on your behalf. In this manner you might be able to work out a payment plan instead of having a tax lien put in on your property.

Tax Reduction Tips

Early Refund Instead of an IRS Tax Lien

When you know that you already have all your important papers gathered together and there is a possibility that you could file your tax returns early, then you might want to have them verified by an IRS tax attorney for errors. After wards you can go ahead and file your IRS taxes, especially if you feel that you might be getting a tax refund. The year 2010 left open a lot of new things that you could use for deductions and this just might help you in what you owe the IRS in back taxes from previous years. The IRS will send you an early refund that you can apply towards your back taxes. Some people prefer to do this so that they will not have to face a tax lien on their property because of unpaid back taxes from previous years. The early refund can be very helpful when you already have a tax lien on some of your personal property.

IRS Tax Lien on Property

The IRS has a right to claim some of your personal property and put a tax lien on it through the federal courts to prevent you from selling or giving the property away. In most cases the IRS will confiscate the personal property and put it up for sale by auctioning it off to the highest bidder. The money that they get goes towards the amount of money that you owe the IRS in back taxes. If you are able to pay what you owe in full, sometimes you can reclaim the items that the IRS has put a tax lien on before they sell the property. When you have a tax refund the IRS will apply that money on what you owe in back IRS taxes. You still owe the balance of your taxes before you can claim anything that the IRS has put a tax lien against.

With tax season quickly approaching, Americans who owe the IRS back taxes they can’t afford to pay will need to know how to swiftly and effectively reduce tax debt while also resolving financially crippling IRS liens and levies.

As the economy begins to slowly rebound, there are some 26 million Americans plagued with some type of tax problem. And with the IRS collection efforts on the rise supported by a record enforcement budget of$5.5 billion, many Americans are a potential target of the IRS and will need to know these tax tips to avoid IRS problems and protect their financial futures.

Tip for Filing Tax Returns #1: Avoid IRS Problems at All Cost If you can’t afford to pay you tax bill in this troubled economy, know that the IRS offers payment options for struggling taxpayers. You can contact the IRS directly for tax help, however, it’s best to consult with a highly qualified tax relief professional first, especially if you owe $25,000 or more, have multiple years of unfiled returns or the IRS wants to audit you, who can help you increase your chances of potentially reducing what you owe and avoiding further IRS penalties.

With the IRS’s enforcement budget at a record $5.5 billion, the most important tip for tax planning this year is to be prepared to file a complete and accurate income tax return to reduce your chances of an audit. This includes understanding how to reduce your tax liability including taking advantage of tax credits, as well as being smart about doing everything in your ability to reduce the chances that your return will be selected for audit, which would cost you much more in the long run.

Tip for Filing Tax Returns #2: File Your Tax Return On Time No Matter What Even if you don’t have the money to pay your tax bill, you should still file your return on time to avoid the 25% failure to file penalty right off the bat. What many people don’t understand is that filing an extension just puts off the inevitable, because it’s not an extension of time to pay, it’s just an extension of time to file.

If you owe the IRS back taxes that you can’t afford to pay come April 15th, you can file your returns and send a money order or cashiers check for $10. This does two important things: first, it takes the large 25% failure to file penalty off your shoulders; and second, it creates a computerized record at the IRS showing that you filed on time and you made a good faith effort to pay some of that money you owe. This will lessen your IRS penalties and may make your negotiations for a tax debt settlement easier later on.

Tip for Filing Tax Returns #3: If You Already Have IRS Problems, Stop Procrastinating The worst thing you can do is ignore your tax problems. And with tax hikes planned for 2011, you need to get your own house in order now. If you have unfiled tax returns and/or you currently owe the IRS money, deal with it now before the new tax hikes kick in. Once you are liable for higher taxes, your penalties and interests will only increase with any subsequent unpaid taxes. If you have failed to file taxes in the past and feel like the IRS is breathing down your back, there is tax relief available.

Regardless of what you’ve heard, you have the right to file your original tax return, no matter how late. With the rising deficit and growing tax gap, collecting funds through more aggressive collection tactics by the IRS will be politically more appealing than raising taxes – so taxpayers beware! Not to mention, the IRS will not entertain any type of tax debt settlement or payment plan to settle your back taxes until you have filed all legally required tax returns

Tip for Filing Tax Returns #4: Know How to Protect the Future of Your Business Many business owners and entrepreneurs face severe IRS problems related to delinquent payroll or sales taxes. I’ve seen firsthand how these tax troubles can cost entrepreneurs their businesses – especially as many business owners continue to struggle in the current economy. Since this group consists of the largest contributors to the national tax gap, they are likely targets for revenue to help reduce the federal deficit, as the IRS grows increasingly aggressive with their collection attempts.

If you’ve fallen behind on your current federal payroll tax deposits or owe the IRS unpaid employment taxes during a period when cash flow was tight, it’s key to avoid the IRS levying your funds and taking control of your cash flow. And keep in mind that having a specialized tax relief professional in your corner to take on the IRS can make all the difference in saving your company that you’ve worked so hard to build.

Tip for Filing Tax Returns #5: Know Your Rights as a Taxpayer With IRS enforcement at an all time high, we can expect the number of IRS audits to continue to rise for both individuals as well as business owners. Every taxpayer has the fundamental rights of due process, fairness and representation- even if the auditor “forgets” to explain this to you. A tax relief professional knows your rights inside and out – so be sure you have someone on your side who knows how to preserve those rights.

Additionally, recent reports have revealed that due to the number of new collection and audit cases (added to the already existing ones) the IRS finds themselves having a difficult time keeping up with an increased caseload and can no longer resolve taxpayer problems in a timely manner. So taxpayers are at a disadvantage when trying to take matters in their own hands. In these cases, taxpayers will want to consider a qualified tax relief professional to be their advocate and effectively protect their taxpayer rights. Think about it: You wouldn’t go to court without a lawyer. So be prepared to know your rights as a taxpayer, or get expert help from a tax attorney or Certified Tax Resolution Specialist who can represent you in front of the IRS, or other State taxing Agency, handling all communications and correspondence, allowing you to continue on with your life.

This article reviews the many ways a taxpayer who owes or who sees they will owe taxes can pay them. There are many different options to pay back taxes including payment plans, the Offer In Compromise (OIC) program, or just how to request an extension.

Tax debt is an ever-growing problem in the United States. It is foolish not to take action when it comes to paying taxes. Failure to explore options leads to the problem becoming increasingly worse. For example, you could be levied and that means your bank account, wages, or personal property can be seized or partially seized. Even if you think you can not afford to pay the IRS, if you work with a professional who can review alternatives for repayment, you will get to the bottom of your tax debt and get it resolved. Here are some alternatives to paying back taxes :

Make A Payment In Full – This is not the easiest thing to do but here are some ways it can be accomplished:

Home equity loans help by shifting your back taxes into your mortgage payment with a lower monthly percentage.

Borrowing money from friends and family. Obviously, do so with the assumed intention of paying them back.

Sell old valuables on Internet sites, such as Ebay. Many people will buy your merchandise if it is in good condition.

Pay using a credit card. Although this may help you initially, do not carry this balance for too long. This balance also accrues interest. Credit card interest is also higher than interest you would accrue on an IRS payment plan.

IRS Payment Plan :
In less than 3 years, with monthly payments, you can pay back taxes. This option requires discipline but monthly payments will get you into compliance with IRS. With this option, you can contact the IRS directory or its easier for a small fee to work with a tax consultant who will represent you.

Offer In Compromise (OIC):

Give evidence or proof that you have no available means of repayment. This will help to show the IRS that you have exhausted other alternatives and can help to reduce your existing debt. An Offer In Compromise is rarely excepted by the IRS. If you are going to pursue this option, then it is best to work with a tax settlement firm because otherwise your OIC will be most likely rejected.

File For A Tax Extension:
Filing a request for an extension can give you time to make the necessary income to pay back State or IRS taxes. You can easily do this for a small fee (around $60) by filing an extension online. Many websites offer this service. It will usually give you 45 days before interest starts accruing so this option is only good if you feel in the next 45 days you will get the money to pay.

If there is a will, there is a way. Talk with an experience IRS professional to explore other means of repaying tax debt. Not filing is worst than admitting to the IRS that you can not afford to pay your taxes. A tax professional will be willing to work with you. They want to save you money, time, and headache. They will work with you diligently in order to do so.

Filing any back taxes is very much so imperative. Non-filing taxpayers are treated much harsher if the Internal Revenue Service catches them before they intentionally. Taxpayers who think the IRS will not figure out they did not file, they are wrong. Ignoring the IRS can even lead to the IRS completing the unfiled return for you, giving you no deductions and they will make sure you owe money even if you normally receive money back.

Prepare required documentation

Gather required tax return information needed to file back taxes. If the IRS finds you didn’t file a return or returns and decides not to prosecute or take legal actions they may file a tax return in your name. If the IRS does this, you can be assured they will not give you any benefit of the doubt and you will have a higher amount owed than if you were to intentionally file on your own. If the IRS has already done this then you need to gather old tax return information to change their return and you need to notify the tax expert you work with know that the IRS has submitted a tax return for you. The Internal Revenue Service Substitute Return tax return should be amended if you want to save money. If you cannot find required paper work, it is good to fill out form 4506-T (Request for Transcript of Tax Return) or your employer or former employer to try to obtain relevant tax information. To file or amend a filing you need tax documents such as a W2, 1099 as well as other documents supporting any deductions you claim. If you cannot obtain old W2′s, you can use the alternative form provided by the IRS which is form 4852.

Find a Reliable Back Tax Expert

Once you have obtained all the tax information you can get a hold of, contact a back tax expert. When selecting a tax firm it is best to work with a tax company that is able to file unfiled returns for you and will help settle taxes owed. You will get the best outcome if you have the same company filing and helping you handle any taxes owed that you cannot pay.

Work with Tax Professional To Prepare Unfiled Returns

You will only have to prepare tax returns for the last seven years. Your tax expert will contact the IRS to let them know you will be filing delinquent back taxes. Filing normal tax returns for each unfiled year will get you into "compliance" with the IRS. There will be charges from using a tax firm but after everything is considered these charges are well worth the money you will save. Once back taxes are filed, you will know how much you owe the IRS or how much the IRS owes you.

Realize your Options when it Comes to Paying your Back Taxes

Next if you cannot pay the tax amount owed then you can work with the tax firm you chose to find the best way for you to reduce and settle tax amounts owed to the IRS. Depending upon your money condition you can choose to pay the taxes owed over an extended period of time through an installment agreement or you may be able to settle your taxes for less than the total amount owed by applying for an offer in compromise, declaring financial hardship or setting up a partial payment plan.

When it comes to solving back taxes owed there are 5 common solutions. It is best that you learn all available options and see what fits your unique situation the best before any steps are taken. Some important factors to figure out prior to deciding what tax debt settlement method to use are your tax amount owed, the greatest amount you can afford to pay, the amount of assets you have, and if you would be able to pay amount in full if you just had more time. Below are the 5 most common ways to solving back taxes.

Offer in Compromise
An offer in compromise is the method that allows individuals to settle IRS back taxes for less than the total amount originally owed. If you have ever heard the saying, "Settle for Pennies on the Dollar", this is the way that is used. It shouldn’t come to a surprise that this is most difficult way to settle with the IRS. The IRS has strict requirements to qualify for an offer in compromise. The offer in compromise tries to find what amount would work best for both the IRS and for the individual. This means the IRS will only settle for less if you can prove it will cost them more to try to get the money from you. This is a good choice if your total assets is less than the amount of back taxes you owe.

Installment Agreement
An installment agreement is the most common method for individuals to settle their back taxes. With an installment agreement you will be required to pay monthly payments towards the tax amount owed in a period of less than 3 years. With an installment agreement you will still have to pay interest on the amounts owed plus and any penalties you may have received, so in the end up paying more than the original tax amount owed. This method should be used if you cannot pay off in full but you can afford to pay off over time.

Stall the IRS
If you need to buy more time to pay the total amount due this can easily by done by using your understanding of the IRS system to your advantage. When the IRS realizes that you owe back taxes, they will begin their sending their automated notices. There are a series of letters that the IRS sends before it actually takes actions against individuals to collect. Typically the IRS sends an original assessment letter stating the amount of tax owed plus any interest and penalties then it will send a series of four CP Letters (Computer notice noted by number on top of letter). These notices go for 4-6 months before the IRS takes action without any action taken on your part. To delay the IRS all you have to do is compose a letter back to the IRS in response to the assessment notice or CP notices and state that you can’t afford to pay at the current time and politely ask for a 45 day extension. If you still cannot pay by this time you can simply repeat the process to buy more time. You must resolve your back taxes before the IRS takes action against you.

Currently Not Collectible
This way won’t resolve your tax debts, but it puts a hold on collections. When you receive currently not collectible status, the internal revenue services will check up yearly on you to see if you have the means to pay at another time. The statute of limitations is still running during this time and if 10 years passes, you will no longer be liable for those tax amounts.

Tax Expert
Tax specialists are many times the most efficient way to get the best results with the IRS. Tax professionals have the highest success rate for getting offer in compromises accepted and for the least amount of money.

Tax specialists can be the best bet for getting the best installment agreement setup with the IRS as well. Most tax experts give free consultations and free quotes to try to get your business. It is best get several free consultations and quotes before making a final decisions.

Thousands of individuals get into tax debt every year, don’t feel alone. Tax code continues to get more and more complex that even the highest ranking IRS individuals don’t even understand it. Knowing your options and taking action early is the best thing to do when dealing with a tax situation.

First of all, if you owe back taxes, don’t be embarrassed. Millions of people are in the same situation as yours. This is especially true for individuals who are 1099′d. No taxes are withheld, which at the time is great because you have more money to yourself. And you think, “By this time next year, I’ll have the money saved up.” But unfortunately that is usually not the way it turns out. Instead, saving your money becomes very difficult. Things happen in life that just seem to get in the way of your plan to save up money for your taxes. That’s life. There’s nothing you can do about that now. Instead focus on the present time. You owe back taxes, so what are you going to do about it?

If you owe less than $10,000 the IRS will put you on a payment plan. If you can afford that, then great! But if you can’t afford that arrangement, or if you owe more than $10,000, then you may have to look at alternative methods of resolving this situation. If it comes down to negotiating a settlement, then it’s important that you know this: The IRS will not negotiate a settlement until all of your taxes have been filed.

So for example, if you have not filed for the years 2005, 2006, and 2007, you’ll need to have your taxes prepared. A reputable tax representation firm will prepare your taxes on your behalf if you decide to go that route. If your returns are simple and you have done them before, then you may be able to do these on your own. Frankly however, you may want to put some serious thought into that. Taxes can be very complicated.

If you owe back taxes and simply cannot afford to pay your back taxes in full or via an installment agreement, you may qualify for a Currently Not Collectible Status. This is basically where your overall situation and your current financial situation prove that you just can’t afford to pay on that for now. Often times the IRS will freeze their collection efforts for up to two years in order to give you time to work this out. Other plans include debt reduction plans such as an Offer In Compromise. This is a program that allows you to pay less than what you owe. Keep in mind that this can be a lengthy procedure.

An interesting point is that sometimes a large percentage of your back taxes are made up of interest and penalty. Under certain circumstances, you may qualify to have your penalties abated. You can request your tax records from the IRS to determine exactly how much you have been charged in penalties. Be forewarned that there is a lot of red tape with the IRS since they are the country’s largest collections bureau. You may want to consider consulting with an IRS Resolution Firm to settle your back taxes if you don’t have the time necessary to devote to the situation, or knowledge required to prepare your documents and file any necessary urgent actions such as stopping or preventing a garnishment or levy. There is much help with back taxes available but first you need to decide to take action.

Describes how unpaid taxes is not uncommon problem in the US. It also describes that self-help advice and professional back tax firms exist for unpaid state or IRS taxes.

Lastly, it reviews important factors to consider when selecting a professional back taxes help firm.

Do you stay up at night worrying about your unpaid taxes? Are you fearful just waiting for the very first phone call from the IRS, or letter demanding payment of your unpaid taxes? Maybe you already have started to get the phone calls or letters.

The stress of dealing with the IRS can be debilitating and may seriously disrupt your life. But, rest assured you are in a boat shared by millions of Americans, especially during these harsh economic times. It’s scary when you owe the government money and all sorts of negative thoughts float through your head. The most common worry is wondering whether or not you will lose your house, or have to endure the financial strain from wage garnishment.

The thing to remember if you have unpaid taxes is that it’s not the end of the world and you have many options. Sure, it may seem like it’s too hard to deal with and you would like to sweep it under the carpet and forget about it, but that is not going to help in the long term because IRS enforcement actions like tax liens and levies will follow.

The IRS wants their money, but they sometimes may accept reasonable cause or reasons for not being able to pay. Moreover, there are tax solutions out there that are not promoted by the IRS so its important to research tax solutions or work with a professional.

The IRS understands you are in a vulnerable position and may be willing to do anything to resolve your tax burden, including cornering you and making threats so that you act quick.

You need expert advice about how to handle your unpaid taxes. The IRS website and other websites offering self-help are a good place to start.

The IRS website is not the most clear on possible tax solutions but other sites go into more depth. Doing a Google search for “back taxes help’ will lead you to a few good websites to start. If self-help fails, you can always turn to professional tax resolution firms that handle everything from filing tax returns, resolving IRS enforcement actions to settling back taxes. Remember, it is best to not do it alone, let an expert show you how it’s done. There are many firms out there but typically teams comprised of tax attorneys, CPAs, and former IRS agents.

When considering a tax firm there are a few factors you should consider in order to have the best outcome. Here are a few you might consider from having expert knowledge of the industry:

What are the fees?
Is there a free no-obligation tax analysis?
Do they have retainer or hidden fees?
Are they a BBB member?
What type of experts comprise their tax firm?
What services do they provide (eg. filing services, representation etc)?

US National BBB.org: News Center
BBBs are supported by 375000 business members throughout North America. In Canada, the first BBB was founded in 1935, and the Canadian Council of Better Business Bureaus was established [...]

Answer these questions by either visiting a back tax help firm’s website or by calling them. Typically you want to work with firm that has no hidden fees, retainer fees and offers a free consultation or tax analysis. A Better Business Bureau member is preferred but not a must. What is a must is firm that can help you file back taxes, settle them, as well resolve any IRS penalties, liens or levies.

Moreover, make sure that they have deep experience. Deep experience means they have tax attorneys, former IRS agents, and CPAs because each type of professional usually in specialized for different tax problems. The IRS tax code and most State tax codes are not easy and therefore having a reputable and diverse firm of professionals is important.

There are millions of people in the same situation and you will get through it as well. Doing due diligence, when picking a tax firm, will save you time, energy, and money in the long run. Most people are not aware of their legal options when dealing with the IRS and that is nothing to be ashamed of – that is why experts exist.
